1. Heard learned counsel for the petitioners as well as learned A.P.P. appearing for the State and learned counsel appearing for the opposite party No.2.

It has been submitted that the F.I.R. was lodged for the offence under Section 494, 498A, 312/34 of the Indian Penal Code and Section 3(i)(S)(W) of the Scheduled Caste and Scheduled Tribe (Prevention of Atrocities) Act and Section 66E of the Information Technology Act. The opposite party No.2 has settled the dispute with her husband and the present petitioners who happen to be father-in-
law, mother-in-law, brother-in-laws and second wife of her husband. In lieu of settlement, a demand draft issued by H.D.F.C. Bank in the name of Dipa Kumari dated 25.10.2024 of Rs. Two Lacs D.D. No.005693 revalidated on 29.01.2025 has been handed over to the
learned counsel for opposite party No.2. Both parties have agreed to settle their dispute and don’t want to proceed in the aforesaid case. Further, continuation of proceedings will amount to abuse of process of law. It is further submitted that one I.A. No.7881 of 2024 has also been filed for quashing the entire criminal prosecution on the basis of compromise which has been arrived at the District Mediation Centre, Koderma. It is further submitted that before the concerned Trial Court, the case of the husband namely Vicky Kumar Keshri was separated and he has faced trial of the case and ultimately acquitted from the charges levelled against him in view of settlement between the parties.

Learned counsel appearing for the opposite party No.2 is also supporting the factum of settlement between the parties on certain terms and conditions and therefore, do not want to proceed with the matter in connection with Koderma (SC/ST) P.S. Case No. 01 of 2021.
4. It appears that F.I.R was instituted by Deepa Kumari (informant) against her husband Vicky Kumar Keshri and others. Informant has claimed that she met Vicky Kumar Keshri in 2010 while working at an NGO and they developed a close relationship. Vicky Kumar Keshri proposed for marriage and on that promise, established physical relationship with informant for nine years. In 2011, Vicky allegedly made an obscene video, blackmailed her and demanded Rs. 4,00,000/-, which informant paid. Informant became pregnant in 2011 and 2018, but Vicky forced her to undergo an abortion. They eventually got married on 24.05.2019, and their marriage was registered on 08.06.2019. Informant was previously married and had a daughter from that marriage. However, informant has claimed that her first marriage ended in 2009 through a social divorce. On 19.06.2019, Vicky Kumar Keshri solemnized a second marriage with another woman. After this, Vicky allegedly
stopped responding to informant’s calls. When informant went to Vicky’s house, she was allegedly abused, assaulted and insulted by caste related remarks by the accused and his family members.
5. It further appears that informant has compromised and settled the dispute with her husband Vicky Kumar Keshari and on the basis of compromise, the marriage of O.P. No.2 has been declared null and void under Section 11 of the Hindu Marriage Act (Annex.2 to I.A. No.7881 of 2024).
6. In view of settlement between the parties, further proceeding in the case in connection with Koderma (SC/ST) P.S. Case No. 01 of 2021 is quashed and this criminal miscellaneous petition is allowed.
7. Accordingly, I.A. No.7881 of 2024 also stands allowed.
