This anticipatory bail application under Section 438 of the Code of Criminal Procedure, has been preferred by the petitioner apprehending his arrest for offences registered under Sections 498(A), 304(B), 201/34 of the Indian Penal Code in connection with Tandwa PS Case No. 280 of 2023 pending in the Court of learned Judicial Magistrate, 1st Class, Chatra. 3. There is serious allegation against the husband of the sister of the informant. Learned counsel representing the petitioner submits that this is not a case under section 304B of the Indian Penal Code. He submits that section 304B IPC is not made out as the girl has been recovered and her statement was recorded. He further submits that victim herself deserted the matrimonial home and is living with some other person. 4. The FIR was lodged on the presumption that the victim who is sister of the informant has been done to death. 5. At this stage, learned counsel for the petitioner seeks permission to withdraw this anticipatory bail application. 6. Permission is granted. 7.
