This bail application under Section 483 & 484 of the Bharatiya Nagarik Suraksha Sanhita, 2023, has been filed to enlarge the petitioner on regular bail for offences under Sections 331(4) & 305(a) of the Bharatiya Nyaya Sanhita, 2023. 3. Learned counsel representing the petitioner submits that neither the petitioner has been named in the F.I.R. nor any incriminating material has been recovered from the possession of the petitioner and he has been falsely implicated in this case on the basis of general and omnibus allegation. He submits that the petitioner is in judicial custody since 23.01.2025. Thus, he may be enlarged on bail. 4. Learned A.P.P. opposes the prayer for bail. 5. Having regard to the facts of the case and looking to the allegation made against this petitioner, I am inclined to enlarge the petitioner on bail. Accordingly, the present Bail Application is allowed. The petitioner, named above, is directed to be released on bail on furnishing bail bond of Rs.20,000/- (Rupees Twenty Thousand Only) with two sureties of the like amount each to the 2025:JHHC:14420 2 satisfaction of the learned Judicial Magistrate, 1st Class, Bermo at Tenughat, in connection with Mahuwatand P.S. Case No.40 of 2024. 6. It is made clear that the petitioner shall appear on each and every date before the learned Trial Court and he shall not threaten any witness and shall co-operate in trial and if any adverse report will come against this petitioner, learned Trial Court shall be at liberty to cancel the bail of this petitioner.
