1. The record reveals that the case was heard at length by this Court on 21.11.2025, on which date Mr. Shuja ul Haq, learned counsel appearing on behalf of the petitioner was confronted with the maintainability of the instant petition and accordingly, sought one week time to have instructions in the matter as to whether the petitioner intend to pursue the matter in the light of the alternate remedy already available.
2. The matter was directed to be listed today. Today when the instant petition was taken up, it has been brought to the notice of the court by the learned counsel appearing on behalf of the respondents that the Dispute Resolution Board (DRB) in respect of the subject contract has already
been constituted by the HQ. CE Northern Command, the constitution of the Dispute Resolution Board (DRB) is as under:

3. Since the petitioner has already availed the alternate remedy of constitution the Dispute Resolution Board, which now stands constituted, the petitioner intends to appear before the said Board and, accordingly, seeks withdrawal of the instant writ petition.
4. Accordingly, the writ petition is dismissed as withdrawn, with liberty to the petitioner to approach the Dispute Resolution Board constituted in respect of the subject contract. The copy of the communication dated 24.11.2025, supplied by
learned counsel for the respondents, is taken on record.
