Heard learned counsel for the parties. 2. The instant bail application has been preferred by the petitioner for grant of regular bail for the offence registered under Sections 395 & 412 of the Indian Penal Code, 1860. 3. Learned counsel for the petitioner submits that he has falsely been implicated in this case and for no offence he is languishing in judicial custody since 09.07.2023. Nothing has been recovered from the possession of the petitioner. As such he may be enlarged on bail. 4. Learned A.P.P. opposed the prayer for bail. 5. Having regard to the facts of the case and also in view of the fact that the petitioner is in custody since 09.07.2023 and there is no likelihood of early conclusion of trial, I am inclined to enlarge the petitioner on bail. Accordingly, the petitioner is directed to be released on bail on furnishing bail bond of Rs. 20,000/- (Rupees Twenty Thousand only) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-V, Dumka in connection with S.T. 2025:JHHC:14448 2 Case No. 255 of 2023 arising out of Jama P.S. Case No. 63 of 2023. 6. It is made clear that till commencement of trial the petitioner shall report to the local police station every month and after commencement of trial he shall appear on each and every date before the learned trial court and he shall not threaten any witness and shall co-operate in trial and if any adverse report will come against the petitioner, learned trial court shall be at liberty to cancel the bail of the petitioner.
