Mr. Vikas Singh Yadav, learned counsel for the applicant. 2. Mr. G.S. Sandhu, learned Government Advocate along with Mr. Vipul Painuly, learned Brief Holder for the State. 3. The present bail application has been filed by the applicant- Ashish. He is under incarceration in connection with Case Crime No.10 of 2025, under Section 8/20/60 of NDPS Act, 1985, registered with Police Station Kankhal, District Haridwar. 4. It is submitted by learned counsel for the applicant that applicant has been arrested on 08.01.2025 on being intercepted by the police party. He was found in possession of 02 kg Ganja. It is further submitted by learned counsel for the applicant that the contraband which has been recovered from the possession of the applicant is below the commercial quantity as the commercial quantity is 20 Kg. 5. On 30.01.2025, learned State Counsel was directed to seek instructions in the matter as to whether the applicant has got any criminal antecedent or not. 6. Today, on instructions, learned State Counsel submits that applicant has no criminal antecedent. 7. Considering the submissions of learned counsel for the parties and without expressing any opinion as to the final merits of the case, this Court is of the view that applicant deserves bail at this stage. 8. Accordingly, the bail application is allowed. 9. Let the applicant-Ashish be released on bail, on his executing a personal bond and furnishing two reliable sureties, each of like amount, to the satisfaction of Court concerned. (Pankaj Purohit, J.)
