ORDER: This Writ Petition is filed under Article 226 of Constitution of India with the following prayer for:
“…pleased to issue Writ Order or Direction more particularly one in the nature of WRIT OF MANDAMUS, to declaring the action of the 5th respondent in interference of the civil litigation and personal liberty of the petitioner, is quite arbitrary, illegal, unconstitutional and against to the principals of natural justice and consequentially to direct the 5th respondent to register the FIR against the respondents 8 and 9 in pursuance of the complaint made by petitioner on 16-6-2020 and consequently to direct the respondent 6 and 7 authorities restraining from changes in revenue records, in respect of the landed property covered by R.S.No.188 with an extent of Ac.2-00, which is situated in Pathuru Village, Bhimadole Mandal, West Godavari District…”
2. Heard Sri Manchanapali Suryanarayana, learned counsel for the petitioner and Sri V.Farooq, learned Assistant Government Pleader for Home for the respondents.
3.
Learned counsel for the petitioner would submit that the petitioner is in peaceful possession and enjoyment of the subject property situated in R.S.No.188, Pathuru Village, Bhimadole Mandal, West Godavari District. He further submitted that despite filing a complaint on 16.06.2020 against respondent Nos.8 and 9, the 5th respondent did not register a case and the police authorities, instead of acting on the said complaint, they are interfering with his civil rights in respect of the property at the instance of the private
5
respondents. He further contends that respondents 6 and 7 are attempting to alter the revenue records relating to the subject land during the pendency of civil proceedings, as such the present writ petition is filed.
4. The learned Assistant Government Pleader for Home would submit that since the subject dispute is civil in nature, the police authorities have not registered any crime on the basis of the petitioner’s representation dated
16.06.2020.
5.
Learned Counsel for the petitioner would submit that recording the same, the petition may be disposed of, giving liberty to the petitioner to pursue the matter before appropriate forum.
6. Recording the same, the Writ Petition is disposed of. However, the petitioner is at liberty to workout his remedies according to law before the appropriate forum. However, it is made clear that the police authorities shall not interfere in the civil dispute between the petitioner and the unofficial respondents in respect of the subject property. There shall be no order as to costs.
As a sequel thereto, miscellaneous petitions pending, if any, shall stand closed. _________________________________________ Dr. JUSTICE VENKATA JYOTHIRMAI PRATAPA Date: 03.09.2025 KKV
