1. The short grievance projected by the petitioner is that he has preferred an application under Section 47 read with Order 21 Rule 26 CPC in December 2024 in an execution petition in the Court of learned District Judge, Baramulla (“Trial Court” for short), however, the same was not accepted and entertained by the said court.
2.
Learned counsel for the petitioner submits that petitioner would feel satisfied if the aforementioned court is directed to accept and entertain his application and dispose of the same.
3. Having regard to the limited nature of controversy involved and the relief sought for, the present petition is disposed of at threshold with a direction to learned Trial Court to entertain and dispose of application of the petitioner strictly in accordance with law.
