Neutral Citation No. - 2025:AHC-LKO:36710 Court No. - 4 Case :- WRIT - A No. - 6971 of 2025 Petitioner :- Vijay Lakshmi Shukla Respondent :- State Of U.P. Thru. Prin. Secy. Bal Vikas Sewa Evam Pushtahar Lko. And 2 Others Counsel for Petitioner :- Prem Shanker Pandey,Abhishek Pandey Counsel for Respondent :- C.S.C. Hon'ble Kshitij Shailendra,J.
1. Heard.
2. The present writ petition has been filed challenging the transfer order dated 14.06.2025 in which petitioner has been transferred from District- Banda to District- Fatehpur.
3. Learned counsel for the petitioner submits that petitioner is residing separately from her husband and is litigating with him at District- Raebareli.
4. Although, matrimonial dispute pending with the husband has no relevance to the controversy involved, inasmuch as it is always open for the petitioner to seek transfer of matrimonial cases from one district to other by taking recourse to the provisions of law, the Court finds that taking ground with regard to two minor daughters residing with the petitioner, who are studying in Banda, the petitioner has filed a representation dated 16.06.2025 before the respondent no.2 with a prayer to set aside the transfer order. It is alleged that the representation has not been decided.
5. Learned Standing Counsel submits that the transfer is an exigency of service and petitioner has been transferred on administrative grounds.
6. Be that as it may, considering the fact that competent authority has been approached by the petitioner citing her personal difficulty, the writ petition is
disposed of with a direction to respondent no.2 -Director Bal Vikas Sewa Evam Pushtahar, Lucknow to consider the petitioner's grievance and take appropriate decision in accordance with law on the application dated 16.06.2025.
7. The petitioner shall file a copy of this order before the respondent no.2 along with photocopy of the previous application dated 16.06.2025 within a week on which the respondent no.2 shall pass appropriate order in accordance with law within a period of two weeks thereafter.
