Neutral Citation No. - 2025:AHC-LKO:37217 Court No. - 18 Case :- WRIT - A No. - 6981 of 2025 Petitioner :- Rahul Verma Respondent :- State Of U.P. Thru. Prin. Secy. Deptt. Of Home Lko. And 2 Others Counsel for Petitioner :- Sarvesh Kumar Tiwari Counsel for Respondent :- C.S.C. Hon'ble Manish Mathur,J.
1. Heard learned counsel for petitioner, learned State Counsel for the opposite parties.
2. Petition has been filed seeking a direction to the authority concerned for conducting a fresh medical examination of petitioner and permit his joining for the training course for the post of Constable in the U.P. Police.
3. It is submitted that after being selected for said post, petitioner was disqualified in the medical examination whereafter he filed appeal but was orally informed about being temporarily unfit in the aforesaid medical test. It is submitted that subsequently petitioner was examined by the Chief Medical Officer, Ayodhya who has certified the petitioner to be medically fit but this aspect has not been taken into
consideration by the opposite parties. Although it is submitted that there is no provision of fresh medical examination but the opposite parties may be issued a direction for the same in the interest of justice keeping in view the certificate of Chief Medical Officer, Ayodhya.
4. Learned State Counsel has refuted the submissions advanced by learned counsel for petitioner with submission that once the petitioner has already been declared unfit not only in the medical examination but also in appeal, there is no such
provision for re-medical examination.
5. Upon consideration of submissions advanced by learned counsel for parties and material available on record, it appears that there is no provision for conducting of fresh medical examination of petitioner, however, the aspect of a certificate issued by Chief Medical Officer, Ayodhya dated 24.05.2025 brought on record as Annexure No. 6 is also a factor in favour of the petitioner.
6. In view of said divergent medical report, liberty is granted to the petitioner to file a fresh representation before respondent no. 2 i.e., Uttar Pradesh Police Recruitment and Promotion Borad, Lucknow along with copy of the Chief Medical Officer Certificate dated 24.05.2025. In case such a representation is moved, the same shall be considered and disposed of in light of the Chief Medical Officer Certificate dated 24.05.2025 within a period of two weeks from the date of production of certified copy of this order before him.
7. With the aforesaid observations/directions, this petition stands disposed of.
