Neutral Citation No. - 2025:AHC-LKO:39176 Court No. - 18 Case :- WRIT - A No. - 6950 of 2025 Petitioner :- Shiv Bansh Verma And 72 Others Respondent :- State Of U.P. Thru. Addl. Chief Secy. Prin. Secy. Deptt. Of Secondary Edu. Lko. And 3 Others Counsel for Petitioner :- Mayankar Singh Counsel for Respondent :- C.S.C. Hon'ble Manish Mathur,J. 1. Heard learned counsel for the petitioners and learned State Counsel appearing on behalf of the opposite parties. 2. Earlier on 27.06.2025, the following order had been passed:- "1. Seventy three petitioners have approached this Court raising a grievance that though they are entitled to be transferred from aspirational districts where they are working to non-aspirational districts and though there is no such clause in the transfer policy which may be treated as an obstruction in such transfer, the respondents have ignored their claim for transfer and have issued transfer lists excluding the claims of the petitioners despite they have applied for transfer. Reliance has been placed on 'Annexure 11' to the writ petition which is a remark available on the online portal containing a recommendation/forwarding made by the District Inspectors of Schools concerned observing that the claim having been examined in the light of transfer policy of 2025, the applicants have been found eligible for transfer. 2. Submission is that despite such positive remark made by District Inspector of Schools on 07.06.2025, the respondent No.4 has not passed any order and, therefore, the petitioners are suffering. 3. Learned Standing Counsel seeks time to place before the Court written instructions in the matter particularly with regard to passing of any order pursuant to the recommendations made by the District Inspector of Schools. 4. Put up this case in the list of fresh cases on 10.07.2025 before appropriate Bench." 3. Learned State Counsel has not been provided any instructions till date. 4. Considering the fact that prayer has been made seeking a direction to opposite parties to consider claim of petitioners for transfer from an aspirational District to any non-aspirational District ignoring the time-line provided in transfer policy dated 20.05.2025, liberty is granted to petitioners to file their individual representations before opposite party no.3, i.e. Director, Secondary Education, U.P. Lucknow. In case such individual representations are filed, the same are required to be decided by authority concerned expeditiously by a reasoned and speaking order within a period of four weeks from receipt of fresh representation of petitioner(s) along with a certified copy of this order. 5. With aforesaid directions, the petition is finally disposed of. Order Date :- 10.7.2025 kvg/- Digitally signed by :- GIREESAN KV High Court of Judicature at Allahabad, Lucknow Bench
