GP FOR SERVICES I The Court made the following: ORDER: Heard the learned counsel for the petitioner and the learned Assistant Government Pleader for Services – I. 2. Challenge in the writ petition is to the proceedings issued in connection with the enquiry initiated vide G.O.Rt.No.702, dated 19.09.2022 against the petitioner after lapse of three (03) years. 2 3. The contention of the petitioner is that the petitioner was appointed as Work Inspector in Visakhapatnam Municipal Corporation on 20.07.1997. Subsequently promoted to the post of Assistant Engineer on 27.01.2003 and thereafter promoted as Deputy Executive Engineer on 01.02.2014. It is contended that the impugned proceedings have been issued framing the charges against the petitioner. 4. Learned counsel for the petitioner contends that the Government is proposing to conduct DPC for granting promotions. The pendency of the present Charge Memo would come in the way of considering his case for promotion. Thus, relying on G.O.Ms.No.257, dated 10.06.1999 requests the Court to direct the respondents to consider his case for promotion without reference to the charges pending against him. It is further stated that in similar circumstances, this Court has earlier disposed of a Writ Petition in W.P.No.5271 of 2025. 5. Having regard to the contentions advanced and having regard to the decision of this Court referred supra, the writ petition is disposed of directing the respondents to consider the petitioner’s case for promotion to the post of Executive Engineer in terms of G.O.Ms.No.257, dated 10.06.1999, if the petitioner is in the zone of consideration and fulfills all requisite qualifications.
