When the request for phodi and durasti was made, it is obviously impermissible for the Revenue Authorities to state that the grant made in favour of the predecessor-in-title of the petitioner is doubtful and proceedings were required to be initiated to cancel the same. Once the application for phodi and durasti is made, the only consideration required is whether there is a requirement for phodi and durasti and not to question the very grant that was made in the year 1958. 3. In that view of the matter, the reasoning given in the impugned endorsement cannot be sustained and the same is quashed. The authorities concerned are directed to consider the claim of the petitioner for phodi and durasti on its merit and pass appropriate - 4 - NC: 2025:KHC:11220 WP No. 2558 of 2025 orders within a period of two months from the date of receipt of a copy of this order. 4.
