(2) Petitioner is a civil contractor registered with Public Works Department. According to him, he was awarded a contract and the assigned work was completed by him to the satisfaction of concerned authorities, however part of the payment for the work done has not been released to him and also his security has been withheld. By means of this writ petition, petitioner has sought the following reliefs:
“1. Issue a writ, order or direction in the nature of mandamus commanding the respondents to release the Security Amount (FDRs) a sum of Rs. 19,20,000/- deposited by the petitioner in the office of Executive Engineer, (Construction Division), Public Works Department, Dugadda, District Pauri. (Annexed as Annexure No. 2).
2. Issue a writ, order or direction in the nature of mandamus commanding the respondents to release the Rs. 45,67,726/- which has been deducted from the security deposited, which has been deposited by the petitioner in the office of Executive Engineer, (Construction Division), Public Works Department, Dugadda, District Pauri. (Annexed as Annexure No. 3 to 9).
3. Issue a writ, order or direction in the nature of mandamus commanding the respondents to direct the respondent authorities to release the Security Amount (FDRs) a sum of Rs. 19,20,000/- of the petitioner and also release the amount of Rs. 45,67,726/- which has been deducted from the security deposited, which has
2025:UHC:9631 been deposited by the petitioner i.e. total amount of Rs. 64,87,726/- due in the office of Executive Engineer, (Construction Division), Public Works Department, Dugadda, District Pauri with 18% interest.”

Learned counsel for the petitioner submits that petitioner has made a representation to the Executive Engineer, but no decision has been taken by him. He submits that petitioner be permitted to make a fresh representation.
(4) Writ petition is, accordingly,
disposed of with liberty to the petitioner to make fresh representation to the concerned Executive Engineer. If he makes such representation within two weeks from today, concerned Executive Engineer shall look into the matter and pass necessary
order within six months from the date of presentation of certified copy of this order.
