Heard learned counsel for petitioners, learned State Counsel appearing on behalf opposite parties 1 to 3 and Mr. Manoj Kumar Shukla, learned counsel for opposite party no.4. 2. Present petition under Article 226 of Constitution of India has been filed seeking direction to authority concerned for deciding application of petitioners submitted on 11.06.2025 and 17.06.2025 for compassionate appointment under U.P. Recruitment of Dependents of Government Servants (Dying in Harness) Rules, 1974 in view of fact that son of petitioner no.1 who was also brother of petitioner no.2 expired while in service on 16.03.2025. Opposite party no.4 is said to be the legally wedded wife of the deceased who is also said to have submitted an Application for compassionate Appointment on 07.04.2025. 3. At present learned counsel for the contesting parties prays that the matter may be directed to be decided by authority concerned. 4. Considering the innocuous prayer, without adverting to merits of the case, opposite party no.2, i.e. Deputy Director Agriculture, District Barabanki is directed to decide the aspect regarding eligibility for compassionate appointment between petitioners 1 and 2 and opposite party no.4, after giving due opportunity of hearing to all concerned. Decision with regard to same shall be taken in accordance with law within a period of eight weeks from the date a certified copy of this order is served upon authority concerned. Petitioners as well as opposite party no.4 shall provide copies of their representation along with certified copy of the order. 5. With aforesaid directions, the petition is finally disposed of.
