PUBLIC PROSECUTOR 2 The Court made the following ORDER: This Criminal Revision Case is filed by the Petitioner/Respondent under Sections 438 and 442 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (for short <BNSS, 2023=) seeking to set aside the Order dated 10.01.2025 passed in MC No.21 of 2020 on the file of the Court of the Special Mobile Judicial First Class Magistrate, Kakinada. 2. The facts of the case are that the Petitioner herein and the respondent No.2 herein are the legally wedded couple and due to disputes between them, they are living separately. Criminal cases, DVC etc., are pending between the parties. The wife also filed MC No.21 of 2020 seeking monthly maintenance against her husband, wherein by impugned order, the Trial Court granted monthly maintenance of Rs.15,000/- to the wife. Questioning the same, the present criminal revision case has been filed by the husband. 3. During the pendency of this case, the parties filed a Memorandum of Understanding (MoU) dated 15.03.2026 requesting to record compromise and dispose of this Criminal Revision Case. 4. Petitioner/Accused & Respondent No.2/Defacto Complainant in this Criminal Revision Case appeared before this Court and they are identified by their respective learned counsels appearing on their behalf. Copies of their Aadhar cards attested by their respective counsel are filed for proper identification. 3 5. Learned Assistant Public Prosecutor is in attendance. 6. As per the Memo of Understanding (MoU), the parties decided to settle the issue amicably at the intervention of elders and the Husband agreed to pay Rs.1.00 lakhs to the wife towards full and final settlement subject to withdraw of the cases filed by the wife against the husband and his family members. 7. The respondent No.2/Wife would submit that she has received Rs.10.00 lakhs from the Petitioner herein towards full and final settlement as per the terms of MoU. The parties expressed that they have no objection to record compromise in this matter. 8. Considering the submissions made, and in the interest of justice, this Criminal Revision Case is disposed of.
