Criminal Petition No. 3907 of 2025
ORDER:
The Criminal Petition has been filed under Sections 480 and 483 of Bharatiya Nagarik Suraksha Sanhita, 2023, (for brevity ‘the B.N.S.S’) seeking for releasing the petitioner/accused No.1 on bail in Crime No.02 of 2025 registered for the offence punishable under Sections 69, 108 read with 3(5) of Bharatiya Nyaya Sanhita, 2023, (for brevity ‘the B.N.S’).
2. The provenance of the case of the prosecution is that, the petitioner and deceased fell in love and they wanted to marry. However, the parents of the deceased objected for that. The petitioner has abetted the deceased to commit suicide by consuming the pesticide and the pesticide was supplied by the fried of the petitioner. Whereas, the friend of the petitioner who supplied the pesticide to the deceased earlier was initially arrayed as one of the accused, later his name was dropped. Similarly the parents of the deceased were also arrayed as accused and their names were also dropped as the ingredients under Section 69 and 108 of ‘the B.N.S.’ did not attract.

Learned counsel for the petitioner submits that the petitioner has been in judicial custody from 22.02.2025 onwards; he has not committed any offence; he was falsely implicated in the case; he is ready to abide by any conditions to be imposed by this Court and urged to enlarge him on bail.
4. Per Contra Ms.P.Akhila Naidu, learned Assistant Public Prosecutor vehemently opposed granting of bail as the prima facie case was established against the petitioner. However, she submits that the petitioner completed 66 days of remand period, and as he has completed the statutory period and urged to pass necessary orders in that regard.
5. In this case, record reveals that the investigating officer has examined eight witnesses. The F.I.R. was lodged on 06.01.2025. The petitioner was arrested on 22.02.2025 and has been in judicial custody since then. He has completed 66 days of his detention in the judicial remand. Of course, the Regional Forensic Science Laboratory report is awaited, but, the petitioner has nothing to do with the said report. If certain conditions are imposed while granting the bail to the petitioner ends of justice would be sub-served inasmuch as the petitioner has completed

the statutory period of 60 days as contemplated under Section 187(3) of ‘the B.N.S.S.’

In view of the above reasons, I am inclined to enlarge the petitioners on bail with the following conditions: i) The petitioner shall be enlarged on bail on executing a bond for a sum of Rs.20,000/- (Rupees Twenty Five Thousand only), with two sureties for the like sum each to the satisfaction of the learned Judicial Magistrate of First Class, Nandyal. ii) The petitioner shall not influence, threaten or induce the witnesses. iii) The petitioner shall cooperate with the investigating officer in further investigation. iv) The petitioner shall not leave the district headquarters without express permission from the learned Judicial Magistrate of First Class, Nandyal. v) The petitioners shall appear before the Station House Officer, Nandyal III Town Police Station, Nandyal, on every Saturday in between 10:00 am and 05:00 pm till the charge sheet is filed.
