This writ petition has been filed for a direction to the Civil Judge (Junior Division), Havali, to expedite the disposal of the application under Order XXXIX Rule 1 and 2 CPC dated 16.08.2023 and application under Section 151 CPC dated 15.01.2025 pending in Regular Suit No.2008 of 2023 (Syed Mohd. Khalid vs. Masroor Hasan and another) and further direct the parties to maintain status quo over the property in dispute. Learned counsel for the petitioner submitted that the petitioner has filed a Regular Suit for permanent injunction before the court concerned and also filed an application under Order 39 rule 1 and 2 CPC which is pending disposal. It is also submitted that the next date fixed in the matter is 07.07.2025 and the defendants have raised construction on the land in dispute and have kept their belongings on the said land. Learned counsel prays that the court concerned may be directed to expedite the matter and to take decision in the matter expeditiously. Considering the request made by learned counsel for the petitioner and without entering into the merit of the case, the sub-ordinate Court is directed to take decision on the interim application filed by the petitioner under Order 39 Rule 1 and 2 CPC on 07.07.2025 and if not possible, then decide the same within the next one week but not later than 14.07.2025.
