1. Heard the learned counsel for the parties.
2. This anticipatory bail application under Section 482 and 484 of Bharatiya Nagarik Suraksha Sanhita, 2023 has been preferred by the petitioner apprehending his arrest for offences registered under Sections 329 (4), 126 (2), 115 (2), 109, 118 (1), 118 (2) of the Bharatiya Nyaya Sanhita, in connection with Kanke P.S. Case No. 219 of 2024, pending in the Court of learned Chief Judicial Magistrate, Ranchi.
3. According to the FIR, allegation of theft as well as giving knife and lathi blows on the victim is levelled against this petitioner.
4. After hearing the parties, I have gone through the case diary. Paragraph no. 8 of the same has the statement of Vinod Kumar Mahto who is the victim. He stated that theft has been committed by Rajesh Kumhar in the hotel near Kadma Chowk Cancer Hospital and when he intercepted him, he assaulted the victim with knife. As medical report is also with the case diary which shows that, there is one lacerated wound which is on the upper part of the forehead.
5. Considering the submission of the victim and nature of injury, I am not inclined to grant anticipatory bail to the petitioner.
6. Accordingly, this anticipatory bail application of this petitioner is dismissed.
