The present petition has been filed challenging the order dated 31.10.2018 whereby the injunction was refused and the appeal preferred against the said order was also dismissed vide impugned order dated 11.12.2018. 3. While dismissing the appeal, the appellate court noticed that the pleadings in support of the plaint that he had easementary rights, were contrary to the facts. In any case, the suit is to be decided as is of the year 2017, as such, seeing no reason to interfere with the said two orders, the present petition is disposed off with direction to decide the Suit No.374 of 2017 expeditiously without giving any adjournments to any of the parties with all expedition.
