JUSTICE MICHAEL ZOTHANKHUMA ORDER Date : 26-06-2025 Heard Mr. SK Deori, learned counsel for the petitioner, who submits that the petitioner was granted an IMFL ‘ON’ license in the year 2006, bearing No. 23/2005-06. However, the said license was suspended, vide order No. KXL.27/2014/740-43 dated 24.03.2015 issued by the Deputy Commissioner, Kamrup (Metro), in exercise of the power conferred under Section 29(1)(b) of Assam Excise Act, 1910. The petitioner’s counsel submits that though the petitioner has submitted various representations through the years, for cancelling the suspension order issued against the petitioner’s IMFL ‘ON’ license, no decision has been taken by the respondents till date. 2. Mr. RR Gogoi, learned counsel for the Excise Department submits that in this writ petition filed by the petitioner, the petitioner has annexed only four representations between the year 2015 and July, 2023, challenging the suspension of the petitioner’s IMFL ‘ON’ license. As 2 (two) years have gone by from the last representation, the petitioner should file a fresh representation to the authority, which shall be decided by the authority. 3. The petitioner’s counsel submits that he does not have any objection to the proposal made by the Mr. RR Gogoi, learned counsel for the Excise Department. 4. In view of the consent of the parties, the petitioner is given the liberty to file a fresh representation to the Deputy Commissioner, Kamrup (Metro) with regard to his grievance against the suspension order. The same should be filed Page No.# 3/3 within a period of 1 (one) week from today. On receipt of the petitioner’s representation, the same should be disposed of by the competent authority within a period of 1 (one) month, from the date of receipt of a certified copy of this order along with a copy of the writ petition. 5.
