This application under Section 482(1) of BNSS, 2023 has been filed by the petitioners, namely, 1. Bahnur Ali and 2. Minara Begum @ Albun Nessa, seeking pre-arrest bail in connection with Mangaldai P.S Case No. 107/2025 (GR No. 425/2025) registered under Sections 103(1)/3(5) of BNS, 2023. 3. The petitioners, herein, named as accused no.2 and 3 in the FIR dated 03.06.2025 stated to be the parents of accused no.1 of the FIR. 4. The allegations in the ejahar is that the accused persons inflicted cruelty and torture upon the informant’s daughter since 6 months of marriage and on the day of the incident, they killed her by stabbing her in the stomach. 5. The petitioner No. 2 was granted interim pre-arrest bail. Today, the learned counsel for the petitioners submits that in the meantime, charge sheet has been laid against the petitioners. It is further submitted that he has instruction that the petitioners along with other co-accused have been charge sheeted but sent up for trial. 6. The learned Additional Public Prosecutor for the State submits that scanned TCR has been received. 7. In view of completion of investigation and cooperation rendered earlier by the petitioner No. 2, the interim protection vide dated 09.09.2025 is hereby made absolute subject to the conditions – that the petitioner No. 2 shall be available for trial if one commences; and that the petitioner No. 2 shall not hamper or tamper with evidence. 8. Further in the event of arrest of petitioner No. 1, he shall be released on bail in connection with Mangaldai P.S Case No. 107/2025 (GR No. 425/2025) Page No.# 3/3 registered under Sections 103(1)/3(5) of BNS, 2023, on furnishing personal bail bond of Rs.5,000/- with one suitable surety of the like amount to the satisfaction of the arresting authority. 9. The direction for bail is further subject to the condition(s) that the accused-petitioner: (a) shall be available for trial, if one commences; and (b) shall not hamper or tamper with evidence. 10.
