2025:JHHC:12304 1 IN THE HIGH COURT OF JHARKHAND AT RANCHI A.B.A. No.3379 of 2024 ------ 1. Most Lilawati Devi 2. Jayanti Devi 3. Most Shanti Devi @ Shanti Devi, wife of Hemlal Singh 4. Shanti Devi, wife of Narayan Singh 5. Anita Devi 6. Sima Devi 7. Tribhuwan Singh 8. Aklu Das ... ... Petitioners Versus 1. The State of Jharkhand. 2. Abdul Rajak Ansari ... ... Opposite Parties ------ CORAM : SRI ANANDA SEN, J. ------ For the Petitioner(s) : Mr. Prabhash Ch. Sinha, Advocate. For the State : Mr. Gautam Rakesh, A.P.P. ----- 11/ 22.04.2025 Heard the parties. 2. This Anticipatory Bail Application under Section 438 and 440 Cr.P.C., has been filed by the petitioners apprehending their arrest for offences under Sections 147, 323, 341, 447, 419, 467, 468, 471, 120B, 506 IPC. 3. Learned A.P.P. representing the State opposes the anticipatory bail application. 4. After hearing the parties, I find that it is alleged that a piece of land has been sold to petitioner Nos.2 to 6 by petitioner No.1. Petitioner No.7 is the identifier of the said agreement and petitioner No. 8 is one of the witnesses. It is further alleged that the land belongs to Khiro Saw but as per the informant, Khiro Saw died issueless. Thus, petitioner No.1 impersonated herself, whereas counsel for the petitioners claim is that she is married daughter of Khiro Saw and is residing in a different village and the agnates are trying to capture the land 2025:JHHC:12304 2 by stating that Khiro Saw died issueless which actually is not. 5. Considering the nature of allegations and the aforesaid fact, this Court is of the prima facie opinion that since petitioner Nos.2 to 6 are purchasers of the land, petitioner No.7 is the identifier and petitioner No.8 is the witness, and they have no role in the entire transaction or impersonation, the petitioner Nos.2, 3, 4, 5, 6, 7 and 8, may be released on anticipatory bail. So far as petitioner No.1 is concerned, she being an old lady of 70 years and claims that she is the daughter of Khiro Saw and widow of late Daho Singh, since there is a dispute about the same and the alleged sale deed which she had executed is not forged, rather registered before the Registry Office, I am inclined to release petitioner No.1 also, on anticipatory bail. 6. Accordingly, this Anticipatory Bail stands allowed. The petitioners, above named, are directed to surrender before the learned Court below within four weeks from the date of receipt of copy of this order and on the event of their surrender or arrest, they shall be released on bail on furnishing bail bonds of Rs.20,000/- (Rupees Twenty Thousand) each, with two sureties of the like amount each, to the satisfaction of learned Chief Judicial Magistrate, Giridih, in connection with Birni P.S. Case No.01 of 2024, subject to the condition that one of the bailers should be a close relative of the petitioners and other should be a resident of State of Jharkhand, having sufficient landed property in his name or in the name of his ancestors in which he is having share and to that effect, he has to file an affidavit before the Trial Court indicating his share in the property.
