Neutral Citation No. - 2025:AHC-LKO:37004 Court No. - 12 Case :- CRIMINAL REVISION DEFECTIVE No. - 313 of 2025 Revisionist :- Shri Prakash Maurya Opposite Party :- State Of U.P. Thru. Secy. Deptt. Of Home Lko. And 2 Others Counsel for Revisionist :- Dhananjai Kumar Tripathi Counsel for Opposite Party :- G.A. Hon'ble Rajnish Kumar,J. This highly belated revision has been filed alongwith an application for condonation of delay. The office has reported a delay of 1050 days in filing the revision. However, no ground of such a long delay, what to say of sufficient ground, has been shown in the affidavit filed in support of the application for condonation of delay. Even otherwise, the application under Section 126 Cr.P.C. filed by the revisionist was dismissed being time barred on the ground that a false plea of knowledge of the ex-parte judgment and order dated 04.05.2022 has been taken on the basis of inspection dated 17.12.2022, after the police reached to his house on 20.04.2024, whereas he had already filed an application under Section 126 (2) Cr.P.C. vide case no.1292/11/2022, which was dismissed on 28.08.2023. Thus, the plea for condonation of delay before the family court was also misconceived and the application suffered from concealment of facts. It is settled law that a litigant who tries to play fraud with the court, he is not entitled to any relief. In view of above, the application for condonation of delay filed by the revisionist is liable to be dismissed alongwith the revision. The application (Cr.M.A. No.02 of 2025) is dismissed. Consequently, the revision is also dismissed. ...................................................................(Rajnish Kumar, J.) Order Date :- 1.7.2025 Haseen U.
