1. Heard Sri M.G. Tripathi, learned counsel for petitioners as well as learned Standing Counsel for respondent Nos. 1 to 8. 2. In light of the proposed order, notices to private respondents are dispensed with. 3. It has been submitted by learned counsel for petitioners that petitioners are the recorded tenure holder of Gata No. 142 which was purchased by the father of the petitioners through a registered sale deed and his name was duly mutated in the revenue records. 4. The dispute in the present case pertains to Gata No. 141 which has been purchased by private respondents who have also commenced construction on the said plot but instead of restraining their constructions over gata No. 141 they have proceeded to extend their construction to the plot of the petitioners situated at Gata No. 142. 5. It has been submitted that in this regard the petitioners had approached local police station where again they were directed to get their plot demarcated. 6. It is in the aforesaid circumstances, present writ petition has been filed seeking a direction to private respondents not to raise construction on Gata No. 142 situated at NFA Tulsipur, Tahsil Tulsipur, District Balrampur. 7. Considering the rival contentions as well as nature of dispute in question, it seems that the dispute pertains to the location of Gata Nos. 141 and 142 which according to the petitioner are adjacent to each other. This Court is of the considered view that this matter can be resolved in case appropriate proceeding for
demarcation are undertaken and carried out. 8. Learned counsel for petitioners does not object to the same. 9.
Accordingly, the writ petition is disposed of by granting liberty to the petitioners to move an appropriate application U/S 24 of the U.P.
