HIGH COURT OF JUDICATURE AT ALLAHABAD LUCKNOW CRIMINAL MISC. BAIL APPLICATION No. - 5905 of 2025 Court No. - 12 HON'BLE PANKAJ BHATIA, J.
1. Heard learned counsel for the applicant, learned AGA and perused the record. 2. The applicant seeks enlargement on bail in FIR No. 97 of 2025, under Sections 64 and 108 BNS, P.S. Behta Gokul, District Hardoi. 3. Learned counsel for the applicant argues that the FIR in question was lodged alleging that the daughter of the informant aged about 18 years used to talk to the applicant on telephone and on 21.4.2025 the applicant was making physical relation with her which was seen by elder daughter of the informant because of which she was scolded and subsequently she consumed some insecticide and committed suicide. The applicant is being prosecuted for offence under Sections 64 and 108 BNS. The postmortem report shows that no definite opinion can be given with regard to the cause of death. The viscera has been preserved. One of the suicide note on record states that the victim wanted to flee with the applicant to which he did not agree and he threatened to show photos to all. Even the said suicide not would not fall within the definition of abetment as defined in the Act. 4. Learned AGA has opposed the bail application. 5. Considering the fact that the post mortem report or any other report does not indicate or substantiate any offence under Section 108 BNS and there is no material to suggest abetment at the instance of the applicant, Versus Counsel for Applicant(s) : Ajeet Kumar Singh Counsel for Opposite Party(s) : G.A., Arjun Singh Somvanshi Ankit Kumar @ Ramsurat .....Applicant(s) State Of U.P. Thru. Prin. Secy. Home Lko. .....Opposite Party(s)
however, without commenting upon the merits of the case, the applicant who is in custody since 24.4.2025 having no criminal history is entitled to be enlarged on bail. In view thereof, the application is allowed. 6.
