HARVINDER SINGH Versus STATE OF HP AND ORS CRMPM-2649 of 2025 01.04.2026 Present: Mr. M.A. Safee, Advocate, for the applicant/appellant. Mr. Rajan Kahol & Mr. Vishal Panwar, Additional Advocates General with Mr. Ravi Chauhan & Mr. Anish Banshtu, Deputy Advocates General, for respondent No.1-State. Mr. J.K. Verma and Mr. Mayank Verma, Advocates, for respondents No.2 to 8. CRMPM-2649 of 2025 By way of instant application filed under Section 5 of Limitation Act, prayer has been made on behalf of the applicant/ appellant for condonation of delay in maintaining the accompanying appeal, which is barred by limitation. Though by way of filing reply, prayer made on behalf of the applicant/ appellant for condonation of delay has been seriously opposed by the non-applicants/respondents, but having carefully perused the averments contained in the application, which is duly supported by an affidavit, this Court finds no impediment in accepting the prayer, especially when delay caused in maintaining accompanying appeal does not appear to be intentional or willful, rather same has occurred on account of circumstances, which were completely beyond the control of the applicant, as such, the same deserves to be condoned. In view of above, delay, which has been otherwise sufficiently explained is condoned. The application is disposed of. Cr. Appeal No. _________ of 2026 (Cr.A(A- SB)ST9654/25) Be registered. Notice.
