24 Supp IN THE HIGH COURT OF JAMMU & KASHMIR AND LADAKH AT SRINAGAR Bail App No. 229/2025 CrlM No. 1718/2025 Showkat Ahmad Tantray ….. Petitioner (s) Through: Mr. Irshad Rasheed, Adv. V/s Union Territory through Police Station Budgam ….. Respondent(s) Through: Coram: Hon’ble Mr. Justice Sanjay Dhar, Judge ORDER 08.11.2025 1. This is an application filed by the petitioner seeking bail in a case arising out of FIR No. 470/2024 for offence under Section 69 of BNSS registered with Police Station, Budgam which is stated to be pending before the court of Additional Sessions Judge, Budgam 2. During the course of arguments, learned counsel for the petitioner has submitted that the petitioner has already moved an application for grant of bail before the learned trial court i.e, Additional Sessions Judge, Budgam in February 2025 but the said application is still pending. P a g e | 2 Bail App No. 229/2025 CrlM No. 1718/2025 3. Having regard to the fact that the petitioner has already moved the application for grant of bail before the court of first instance is correct then it would be appropriate that the said court is allowed to pass orders on the said application in accordance with law. However, if what the petitioner has pleaded in this bail application, the time taken by the learned trial court in disposing of his bail application appears to be highly excessive. Thus, a direction needs to be extended to the learned trial court to ensure expeditious disposal of the bail application of the petitioner. 4. Accordingly the bail application is disposed of with a direction to the learned trial court to decide the bail application of the petitioner most expeditiously preferably within a period of three weeks from the date a copy of this order is made available to the learned trial court. 5. Disposed of as above. (Sanjay Dhar) Judge SRINAGAR 08.11.2025 Aasif
