Adityapur, District Seraikella- Kharsawan, Jharkhand. 2. Maniya Devi, wife of Ashok Prasad, resident of H. No. 52, Jamalpur, P.O Gamharia, P.S. Adityapur, District- Seraikella-Kharsawan, Jharkhand. 3. Ashok Prasad, son of Shiv Mangal Prasad, resident of H. No. 52, Jamalpur, P.O Gamharia, P.S. Adityapur, District- Seraikella-Kharsawan, Jharkhand. ..... Petitioner(s). Versus The State of Jharkhand … Opp. Party(s). ------ CORAM : SRI ANANDA SEN, J. ------ For the Petitioner(s) : Mr. Manoj Kr. Choubey, Advocate. For the State : Mr. Bishambhar Shastri, A.P.P. …..... 04/19.06.2025: This anticipatory bail application under Section(s) 482 and 484 of the Bharatiya Nagarik Suraksha Sanhita (BNSS), 2023, has been preferred by the petitioner apprehending her arrest for offences registered under Section(s) 108/3(5) of BNS-2023. Heard the parties at length and had gone through the documents, annexed along with this application. Opportunity was given to the State to oppose the bail, which the State availed and opposed. It is alleged by the informant that his daughter, aged about 19 years, committed suicide. It has been further alleged that one Sanjit Patel who is the younger brother of petitioner No. 1 once entered the house of the informant, but, the informant rebuked him. Thereafter, these petitioners went to the house of informant with intention to quarrel with them. It has also been alleged that these petitioners also use to give threat to the informant's party including the deceased-daughter. It is further alleged that they were trying to interfere in the marriage proposal of the deceased and tried to jeopardise the negotiations, thus the deceased committed suicide. Considering the nature of allegations against these petitioners, prima facie, I find no material at this stage to arrive at a conclusion that these petitioners have abated suicide. Thus, I am inclined to allow this anticipatory bail application. Accordingly, the petitioners, above named, are directed to surrender before the court below within four weeks from today and in the event of their surrender/arrest, the court below is directed to enlarge them on bail on furnishing bail bond of Rs.10,000/-(rupees ten thousand) each with two sureties of the like amount each to the satisfaction of the learned CJM, Seraikella, in connection with Adityapur P.S. Case No. 44 of 2025, subject to condition that one of the bailers should be close relative of the petitioners and other should be a resident of State of Jharkhand, having sufficient landed property in his/her name or in the name of his/her ancestors in which he/she is having share and to that effect, he/she has to file an affidavit before the Trial Court indicating his/her share in the property.
