Mr. Devesh Saini, learned counsel for the Revisionist.
2. Mr. Bhaskar Chandra Joshi, learned AGA along with Mr. Vijay Khanduri, learned Brief Holder for the State.

Instant revision has been filed by the revisionist for setting aside the impugned order dated 08.08.2024 passed by the learned Special Judge (N.D.P.S.)/District and Session Judge, Tehri Garhwal in Criminal Misc. Case No.76 of 2024 State vs. Pulkit and another as well as the impugned order dated 10.12.2024 passed by learned Special Judge (N.D.P.S.)/District and Session Judge Tehri Garhwal in Misc. Criminal Case No.69 of 2024 Gaurav Shiva vs. State of Uttarakhand and direct the concerned authorities to release the vehicle Bajaj Pulsar DTSI 220 cc. Motorcycle Bearing Registration No.UK17 G 0930, Chassis No.MD2A13EY4HCG81675, Engine No.DKYCHG706430 to the revisionist/owner/Gaurav Shiva.

According to the FIR registered on 28.12.2024 at 18:40 Hrs. at Police Station Muni Ki Reti, District Tehri Garhwal the allegation is that on 28.12.2024 after getting the information from the special informer that on the occasion of New Year two boys have come to sell illegal hashish (charas) in the ashram/hotels near Tapovan who has a black colour Pulsar motorcycle bearing number UK17G- 0930; one of them is Pulkit and the other is Vasu. Based on this information the police personal started moving upwards from Neem Beech; at the junction of the unpaved road, they saw a black colour Pulsar coming from Vishwa Chetna Ashram road; pointing towards the person riding the motorcycle, the special informer said that this is
Pulkit; the team ran fast and caught the said vehicle. The person told his name Pulkit and the person who was with him told his name Vasu.

Learned counsel for the revisionist submits that revisionist has no knowledge about the said crime; he submits that vehicle was seized only due to giving the same to his friend Pulkit. He submits that during trial the learned Special Judge (N.D.P.S.)/District and Sessions Judge, Tehri Garhwal was released the said vehicle but again it was taken by the police in their possession after conviction of the accused Pulkit.
6. Learned State counsel concedes the fact that the revisionist is the real owner of the vehicle.
7. Having heard the submission of the learned counsel for the parties, the instant revision is
disposed of with the condition that revisionist shall furnish a reliable surety and a personal bond of Rs.30,000/- before the court concerned. The S.H.O. of the concerned Police Station is directed to release the vehicle, if the said vehicle is not found involved in any offence.
8. Pending applications, if any, stand disposed of.
