OMP(M) No.115 of 2024 Instant application has been filed under Section 5 of Limitation Act seeking condonation of 18 days of delay in filing the instant appeal. 2. Perusal of Paras 3 & 4 of the application indicates that delay had occurred as the certified copy of the orders dated 20.01.2024 could not be applied by the office Clerk concerned within time. Application is supported by an affidavit. 3. Pursuant to issuance of notice, the non- applicant-respondent has filed the reply, objecting to the condonation of delay on the ground that the reasons do not disclose a sufficient cause and therefore, in these circumstances, prayer is made for not allowing the application. 4. Taking into account the entirety of the facts and circumstances coupled with the fact that a litigant should not suffer either due to the fault of learned counsel or his office staff as in this case, coupled with the fact that arguable points are involved in the accompanying appeal, therefore, the application is allowed and the delay of 18 days in filing the accompanying the appeal is condoned.
