Neutral Citation No. - 2025:AHC-LKO:38215 Court No. - 5 Case :- WRIT - A No. - 6946 of 2025 Petitioner :- Sanjay Shukla Respondent :- State Of U.P. Thru. Prin. Secy. Energy Deptt. Lko. And 5 Others Counsel for Petitioner :- Rama Niwas Pathak Counsel for Respondent :- C.S.C.,Ran Vijay Singh Hon'ble Abdul Moin,J. 1. Heard learned counsel for petitioner, learned Standing Counsel for respondent no.1 and Sri Ran Vijay Singh, learned counsel appearing for respondents no.2 to 5. 2. With the consent of learned counsels appearing for the contesting parties, the writ petition is being finally decided. 3. Instant petition has been filed praying for quashing of the transfer order dated 11.06.2025, a copy of which is Annexure no.1 to the petition, so far as it pertains to the petitioner, whereby the petitioner has been transferred from district Ayodhya to Amethi. 4. The contention of learned counsel for the petitioner is that as the petitioner is 60% permanently specially abled person, as per the certificate dated 06.03.2012, a copy of which is Annexure-2 to the petition, issued by the competent authority, as such he cannot be transferred. 5. However the Court is of the view that the said ground falls in the realm of the grounds to be considered by the respondents at the first instance. 6. Accordingly, without entering into the merits of the case, the present petition is disposed of leaving it open to the petitioner to submit a comprehensive representation against the impugned transfer orders dated 11.06.2025 before the competent authority i.e. Chief Engineer Madhyanchal Vidyut Vitran Nigam Ltd. Ayodhya / respondent no. 4 within a period of two weeks from today. 7. In case such a representation is made, respondent no. 4 shall proceed to decide the same in accordance with law considering the grounds taken by the petitioner in the representation, which would be decided within a period of six weeks from the date of receipt of the representation alongwith copy of this order. 8. Till disposal of representation no coercive action shall be taken by the respondents against the petitioner in pursuance of the impugned transfer order. 9. It is made clear that if the petitioner does not submit his representation within the time specified, then the benefit of this order shall not be available to him. Order Date :- 7.7.2025 A.
