Neutral Citation No. - 2025:AHC-LKO:37312 Court No. - 12 Case :- APPLICATION U/S 482 No. - 5228 of 2025 Applicant :- Manish Kapoor And 2 Others Opposite Party :- The State Of U.P. Thru. Prin. Secy. Home Lko. And Another Counsel for Applicant :- Rajat Bansal,Anil Kumar Tiwari,Rushida Farheen Counsel for Opposite Party :- G.A. Hon'ble Rajnish Kumar,J. Office had reported a defect that the deponent and the counsel have not signed the affidavit but learned counsel for the petitioners declined to file supplementary affidavit and the affidavit indicates that signatures have been made by the deponent, therefore it is apparent that the signatures have been made by the deponent subsequent to the report submitted by the office, which could not have been done. Learned counsel for the petitioners instead of filing such an affidavit, should have filed a fresh affidavit. At this stage, Ms. Rushida Farheen, learned counsel for the petitioner submits that inadvertently the signatures have been made and she assures that in future it will not be done. She further submits that the application may be dismissed as not pressed with liberty to file fresh. To which there is no objection by learned AGA. In view of above, the petition is dismissed as not pressed with liberty as aforesaid. As prayed by learned counsel for the petitioner, office is
directed to return the certified copy/copies annexed with this application to learned counsel for the petitioner after keeping the photocopy/photocopies of the same on record in accordance with law.
