As per allegation of the FIR and the charge sheet, the present applicant, who was a Driver of JCB, was assigned the job to fill the soil in the pits after raising pillars of the police station concerned and the son of the informant might have fallen down in the pit and the present applicant could not see this fact and such incident took place in the back of the JCB machine; recital to this effect has been given in para-15 of the bail application.
