This is an application filed by the petitioner praying for grant of anticipatory bail in terms of Sections 482 and 484 of Bharatiya Nagarik Suraksha Sanhita, 2023 apprehending his arrest for the offences under Section 498-A of IPC in connection with Complaint Case No.324 of 2022, pending in the Court of learned Chief Judicial Magistrate, Sahibganj. 3. Petitioner is the husband. 4. There is allegation against the petitioner that he has tortured his wife and demanded dowry. 5. Admittedly, this case arises out of complaint and petitioner has approached this Court seeking anticipatory bail after summons has been issued once cognizance has been taken. This case is covered by the judgment passed by the Hon’ble Supreme Court in the case of Satender Kumar Antil vs. Central Bureau of Investigation & Another, reported in (2021) 10 SCC 773 wherein offences have been categorized in four categories. This case being a complaint case where cognizance has been taken falls in category-A. Thus, the direction of the Hon’ble Supreme Court in respect of cases which falls in category-A is to be applied in this case. 6. Petitioner should appear before the Court concerned and take an appropriate step and the Court will pass an appropriate order in terms of the judgment of the Hon’ble Supreme Court. 7. Accordingly, the instant anticipatory bail application stands disposed of. (ANANDA SEN, J.) R.S./
