1. Sri Mohd. Shahid Akhtar, Advocate has filed his Vakalatnama today in Court on behalf of the complainant. The same is taken on record. 2. Heard Sri Manoj Kumar Singh, learned counsel for the applicant as well as Sri Mohd. Shahid Akhtar, learned counsel for the complainant and Dr. Suresh Singh, learned Additional Government Advocate for the State. 3. As per learned counsel for the applicant, the present applicant-Ramrani is languishing in jail since 27.04.2025 in Case Crime No. 188/2025, under Sections 85, 80(2) BNS and Section ¾ Dowry Prohibition Act, Police Station Kotwali Bhinga, District Shrawasti. 4. Learned counsel for the applicant has submitted that the present applicant has been falsely implicated in this case as she has not committed any offence as alleged in the prosecution story. 5. Attention has been drawn towards the impugned First Information Report (in short F.I.R.), wherein the general allegation of torturing and demanding dowry has been levelled against six accused persons including the present applicant. The present applicant is mother-in-law of the deceased. Her relation with her daughter-in-law was cordial. She never demanded any dowry from her or her family members. Even as per prosecution story, so narrated in the F.I.R., the four wheeler car was being demanded by his son, who is husband of the deceased. The cause of death is strangulation, however the hyoid bone is intact, therefore, this case may be a case of hanging. There are some minor injuries on the body of the deceased, but the present applicant is absolutely unaware as to how the deceased sustained such injuries. There might be any dispute between husband and wife, but she is absolutely unaware about this fact. 6. Learned counsel for the applicant has further submitted that
the Charge-sheet has been filed, therefore, there is no apprehension of influencing any witness or tampering evidence. There is no criminal history of any kind whatsoever against the present applicant.
He has undertaken on behalf of the present applicant that the applicant shall not misuse the liberty of bail, if so granted by this Court, and shall abide by all terms and conditions of the bail order and shall cooperate with the trial proceedings properly. Besides, being a lady she may be given the benefit of Section 480 BNSS. 7. Per contra, learned Additional Government Advocate and
learned counsel for the informant have opposed the aforesaid prayer of learned counsel for the applicant but they could not disputed the aforesaid contention of learned counsel for the applicant. 8. Having heard learned counsel for the parties and having persued the material available on record; considering the fact that the as per prosecution story, so narrated in the F.I.R., the four wheeler car was being demanded by his son, who is husband of the deceased; the present applicant is having no prior criminal history of any kind whatsoever and the undertaking that the applicant shall not misuse the liberty of bail and shall abide by all terms and conditions of the bail order and shall cooperate in the trial proceeding properly, the fact that she being a lady she may be given the benefit of Section 480 BNSS, without expressing any opinion on merits of the case, I am of the view that the present applicant may be released on bail. 9. Accordingly, the instant bail application is allowed. 10. Let the present applicant (Ramrani) be released on bail in the aforesaid case crime number on her furnishing a personal bond and two sureties each in the like amount to the satisfaction of the court concerned with the following conditions:- (i) The applicant shall file an undertaking to the effect that she shall not seek any adjournment on the dates fixed for evidence when the witnesses are present in court. In case of default of this condition, it shall be open for the trial court to treat it as abuse of liberty of bail and pass orders in accordance with law. (ii) The applicant shall remain present before the trial court on each date fixed, either personally or through her counsel. In case of her absence, without sufficient cause, the trial court may proceed against her under Section 229-A of the Indian Penal Code/269 of the B.N.S., 2023. (iii) In case, the applicant misuses the liberty of bail during trial and in order to secure her presence proclamation under Section 82 Cr.P.C./84 of B.N.S.S., 2023 is issued and the applicant fails to appear before the court on the date fixed in such proclamation, then, the trial court shall initiate proceedings against her, in accordance with law, under Section 174-A of the Indian Penal Code/208 of the B.N.S., 2023.
