GP FOR SERVICES I The Court made the following: 2 CGR, J W.P.No.9352 of 2025 ORDER: The present writ petition is filed under Article 226 of the Constitution of India for the following relief: “…to issue a writ or writs more particularly in the nature of writ of mandamus declaring the impugned action of the 4th respondent under the guise of enquiry in placing the petitioner out of contract employment temporarily vide impugned proceedings cum show cause No.k1/018/25, dated 15.02.2025 though unwarranted and continuing as such though the petitioner submitted his explanation to the show cause notice and threatening to terminate the services of the petitioner by hook or crook though the petitioner has not committed any irregularities or misconduct insisting the petitioners to submit resignation to his posts and not paying salaries as illegal, arbitrary, high handed, discriminatory, violation of principles of natural justice and cannot be justified in the eye of law and consequently direct the respondents to continue the petitioner as Field Assistant of Arei gram panchayat with all consequential benefits and to pay pending salary in the interest of justice and pass such other order…” 2. Heard Sri Ch. Srinivas, learned counsel for the petitioner, learned Government Pleader for Services-I appearing for respondent Nos.1 to 3, Sri M.S.R. Chandra Murthy, learned Special Counsel appearing for the 4th respondent and Smt. B.V. Aparna Lakshmi, learned counsel for the 5th respondent. 3. The case of the petitioner is that while working as a Field Assistant in Arei Gram Panchayat, KVB Puram Mandal, Chittoor District, he was placed under temporary suspension by proceedings dated 15.03.2025, on certain allegations. He was called upon to submit an explanation for the said allegations, to which he responded by 3 CGR, J W.P.No.9352 of 2025 submitting his explanation on 06.03.2025, refuting the charges. As no further enquiry appeared to be contemplated and steps were being initiated against him, the petitioner preferred the present writ petition. 4. Sri M.S.R. Chandramurthy, learned Special Counsel appearing for the 4th respondent, submits that after receipt of the explanation, the petitioner was issued a notice dated 12.03.2025, calling upon him to appear for a hearing scheduled and held on 28.03.2025. The petitioner appeared in person and participated in the enquiry. Learned Special Counsel further submits that the 4th respondent is in the process of concluding the enquiry and that the final orders are awaited. 5. In view of the aforesaid submissions and with the consent of both learned counsel, the Writ Petition is disposed of, at the stage of admission, with a direction to the 4th respondent to complete the enquiry and pass a reasoned and speaking order, strictly in accordance with law, within a period of two (2) weeks from the date of receipt of a copy of this order. There shall be no order as to costs.
