Heard Sri Mangal Sen Yadav, the learned counsel for the applicant and Sri Hansraj Verma, the learned A.G.A. appearing on behalf of the State. 2. By means of the instant application filed under Section 483 Cr.P.C. the applicant has sought a direction for expeditious disposal of Complaint Case No.3341 of 2021 titled as "State Vs. Ashish Yadav and other", arising out of case crime No. 1594 of 2011, under Section 468A, 323, 504, 506 I.P.C and 3/4 of Dowry Prohibition Act, P.S Kotwali Nagar, District Sultanpur, which is pending in the Court of learned Chief Judicial Magistrate, Sultanpur. 3. Keeping in view the nature of the relief sought, the application is disposed of and accordingly issuance of the notice to the opposite party no.2 is dispensed with. 4. A copy of the order sheet of the trial court has been annexed with the application which indicates that applicant had lodged an F.I.R on 10.12.2011. After investigation, a charge sheet was submitted on 04.04.2012. The trial court took cognizance of the offence and summoned the accused persons by means of an order dated 23.08.2022. One of the accused person- Ram Achal Yadav died during pendency of the case and the proceedings were abated against him by means of an order dated 08.01.2016. In any case, not a single prosecution witness has been examined till date. 5. A perusal of the order sheet indicates that on numerous occasions, the case has been adjourned due to absence of the accused person and it appears that no effective measures are being taken for including attendance of the accused persons. 6. In these circumstances, it appears that the trial court is being unduly delayed and it is not proceeding expeditiously. 7. Keeping in view the aforesaid facts, the instant application is allowed and the learned trial court is directed to proceed with the trial of the Complaint Case No.3341 of 2021 expeditiously, without granting any unnecessary adjournments to any of the parties. .
