Serial No. 29 Regular Cause List IN THE HIGH COURT OF JAMMU & KASHMIR AND LADAKH AT SRINAGAR WP(C) 278/2025 CM (636/2025) Sukaina Sajad and Anr …Appellant/Petitioner(s) Through: None. Vs. Union Territory of J and K and Ors. …Respondent (s) Through: Mr. Faheem Nisar Shah, GA. CORAM: HON’BLE MR. JUSTICE SANJEEV KUMAR, JUDGE ORDER 26.12.2025 1. This is a petition by the petitioners who claim to have married out of their own free will and volition. Apparently both the petitioners are major and capable of entering into contract of marriage out of their free will and volition. This petition seems to have been filed on the apprehension that respondent No. 4, who is opposed to their marriage, may harm their life and liberty by taking law in his own hands. 2. This petition came up before this Court on 13th February, 2025, when this Court while issuing notice to the respondents directed the official respondents 1 to 3 to provide necessary protection to the petitioners as and when they approach the police station concerned for assistance. The direction was passed on 13th February, 2025, however, no steps have been taken by the petitioners for service of respondent No. 4. 3. Be that as it may, having regard to the nature of the controversy involved, this petition is disposed of by directing that in case the petitioners still apprehend any threat to their life and liberty, they shall be free to approach the concerned police station for seeking protection. Needless to say that the police authorities, if approached by the petitioners in this regard, shall take remedial measures as are permissible in law so as to ensure the protection of their life and liberty. 4. Disposed of. (SANJEEV KUMAR) JUDGE SRINAGAR: 26.12.2025 “Shahid Manzoor”
