Neutral Citation No. - 2025:AHC:118969 Court No. - 65 Case :- CRIMINAL MISC. BAIL APPLICATION No. - 3670 of 2025 Applicant :- Bacche Lal Bind @ Ramji And Another Opposite Party :- State of U.P. Counsel for Applicant :- Pradeep Kumar Rai,Prakhar Saran Srivastava Counsel for Opposite Party :- G.A. Hon'ble Krishan Pahal,J.
1. List has been revised. 2. Heard Sri Prakhar Saran Srivastava, learned counsel for the applicants and Sri R.P. Patel, learned State Law Officer for the State and perused the record. 3. Applicants seek bail in Case Crime No. 54 of 2024, under Sections 498A, 304B IPC and Section 3/4 of D.P. Act, Police Station Sigra, District Varanasi, during the pendency of trial. 4. Learned counsel for the applicants has argued that the applicants are absolutely innocent and have been falsely implicated in the present case. They have nothing to do with the said offence as alleged in the FIR. The applicants are the father-in-law and mother-in-law of the deceased person. There are general and omnibus allegations against all the accused persons. 5. Learned counsel has further stated that the deceased has committed suicide as she had consumed aluminum phosphide. The said fact has been ascertained from the viscera report itself. The deceased was suffering from growth in her breast, as such had committed suicide. The said fact stands fortified from the statement of PW-1, who has stated that earlier on, victim was suffering from Tuberculosis, although she was cured from the said ailment. Subsequently, she observed growth in her breast, as such was being treated for it. 6. Learned counsel has further stated that there is no injury observed by the doctor conducting autopsy of the deceased person. The trial is moving at snail's pace and there is no likelihood of early conclusion of trial in near future. The case of the applicants
is at different footing as they are father-in-law and mother-in-law. 7. There is no criminal history of the applicants. The applicants are languishing in jail since 03.12.2024 and they are ready to cooperate with trial. In case, the applicants are released on bail, they shall not misuse the liberty of bail. 8. Per contra, learned State Law Officer has vehemently opposed the bail application but unable to dispute the submissions raised by the learned counsel for the applicants and also the fact that the applicants have no criminal history. 9.
Considering the facts and circumstances of the case,
submissions made by learned counsel for the parties and taking into consideration the fact that there are general and omnibus allegations against all the accused persons, I find it a fit case to release the applicants on bail. The bail application is allowed.
10. Let the applicants - Bacche Lal Bind @ Ramji and Badama Devi, who are involved in aforementioned case crime be released on bail on their furnishing a personal bond and two sureties each in the like amount to the satisfaction of the court concerned subject to following conditions. Further, before issuing the release order, the sureties be verified. i) The applicants shall not tamper with the evidence during trial. ii) The applicants shall not pressurise/intimidate with the prosecution witnesses. iii) The applicants shall appear before the trial court on the date fixed.
11. In case of breach of any of the above conditions, it shall be a ground for cancellation of bail.
12. It is made clear that observations made in granting bail to the applicant shall not in any way affect the learned trial Judge in forming his independent opinion based on the testimony of the witnesses.
