U.P. Lko. Counsel for Applicant :- Vinod Kumar Pandey Counsel for Opposite Party :- G.A. Hon'ble Shree Prakash Singh,J.
1. Heard learned counsel for the applicant, learned A.G.A. for the State and perused the record. 2. The instant bail application has been filed on behalf of the applicant with the prayer to release him on bail during the trial in FIR/Case Crime No.67 of 2025, under Sections 115(2), 352, 351(3), 103(1), 333, 3(5) B.N.S., Police Station- Kadipur, District- Sultanpur. 3. Learned counsel for the applicant submits that the applicant is innocent and has falsely been implicated in the present case. He next submits that general role has been assigned to all the accused for committing offence, but subsequently a danda has been shown to be recovered from joint possession of the present applicant and other co-accused. He further submits that co-accused Shivam @ Shiv and Arun Kumar @ Arun have already been granted bail by this Court vide orders dated 11.06.2025 passed in Crl. Misc. Bail Application Nos.5188 of 2025 and 5194 of 2025 respectively. He further submits that the applicant has no previous criminal history and languishing in jail since 17.02.2025 and he undertakes that in case, he is granted bail, he will not misuse the liberty of the same and would cooperate in the trial proceedings, thus submission is that he may be enlarged on bail. 4. Per contra, learned AGA appearing for the State has opposed the contentions aforesaid and submitted that the applicant is involved in committing the offence and he was named in the FIR, as such, he is not entitled for bail. 5. Having heard learned counsel for the parties and after perusal of material placed on record, it transpires that general role has been attributed to all the accused persons and two co-accused, namely Shivam @ shiv and Arun Kumar @ Arun have already been enlarged on bail by this Court. This Court has also noticed the fact that though the danda has been shown to be recovered on pointing out of the present applicant including all co-accused persons, but that prima facie seems to be against the provisions of the Evidence Act.
Further the applicant has no criminal history and is languishing in jail since 17.02.2025 and the applicant undertakes that in case, he is granted bail, he will not misuse the liberty of same and would cooperate in the trial proceedings. 6. Considering the submissions of learned counsels for the parties, nature of accusation and severity of punishment in case of
conviction, nature of supporting evidence, prima facie satisfaction of the Court in support of the charge, reformative theory of punishment and considering larger mandate of the Article 21 of the Constitution of India and, without expressing any view on the merits of the case, I find it to be a fit case of bail. 7. Let the applicant- Pushkar involved in the aforementioned crime be released on bail, on his furnishing a personal bond and two sureties each in the like amount, to the satisfaction of the court concerned, with the following conditions:- (i) The applicant shall not tamper with the prosecution evidence by intimidating/ pressurizing the witnesses, or otherwise during the investigation or trial; (ii) The applicant shall file an undertaking to the effect that he shall not seek any adjournment on the dates fixed for evidence when the witnesses are present in court.
