ORAL ORDER
The petitioner-accused who has been charge sheeted for the offences punishable under Sections 341, 354, 307, 324, 506 of IPC is before this Court seeking relief.
2. The prosecution alleges that the petitioner-accused who came in contact with the complainant through her friends fell in love with her, and they have been to Goa on a Trip along with their friends. The complainant refused the proposal of the petitioner-accused, and on 25.8.2021, the petitioner-accused came near the house of the complainant and tried to slit her neck with a knife and while trying to escape from the assault, she sustained injuries and thereafter, the petitioner-accused tried to pour petrol on her, at that time, the complainant's brother came to her rescue.

The petitioner-accused and the complainant are present before this Court and through their respective counsels have filed an application for compounding of the offences stating that they have amicably resolved the dispute among themselves, and in terms of the settlement, the respondent No.2 has agreed to withdraw all the allegations, and has no

objection for quashing the impugned proceedings made against the petitioner-accused.
4. The application is placed on record.
5. Offence under Section 307 of IPC is punishable with life imprisonment. The complainant has sustained simple injuries on the neck due to the alleged assault made by the petitioner-accused. There is no material to substantiate that the petitioner-accused poured petrol on the complainant to kill her. If the petitioner-accused is subjected to trial, it would be a futile exercise, since the probabilities of his conviction is remote and bleak in view of the settlement arrived between the parties. In such circumstances, the continuation of the criminal proceedings would be an abuse of the process of law.
6. Accordingly, I pass the following:
ORDER
i) The Criminal petition is allowed
ii) The Impugned proceedings in S.C.No.1445/2021, on the file of the learned Principal City Civil and Sessions Judge, Bengaluru, insofar it relates to accused-petitioner herein is hereby quashed.
