Her grievance is to the office order dated 07.05.2025 (Annexure P-1), whereby, she has been transferred from Civil Hospital Dalhousie to Pandit Jawahar Lal Nehru Government Medical College Chamba. Her husband is a serving soldier in Army Medical Corps and till recently was 1 Whether reporters of Local Papers may be allowed to see the judgment? yes - 2 - posted at Dalhousie. 2. Petitioner’s case is that expecting her husband’s posting to a field location, giving details of her family circumstances, coupled with the fact that she is wife of a serving soldier, she preferred a representation on 08.05.2025 (Annexure P-3) to the respondent-Health Department, requesting for changing her posting to Dr. Radha Krishanan Government Medical College Hamirpur, H.P. Petitioner’s request has also been recommended by the officiating Commanding Officer, Military Hospital Dalhousie, under whom her husband had been serving. Petitioner’s grievance is that her representation has not been considered by the competent authority and further that she has been relieved under office order dated 02.05.2025 directing her to join the office of Director Medical Education and Research, Shimla. Learned counsel for the petitioner contends that petitioner’s husband has since been transferred in the State of Uttar Pradesh. 3. In view of the case made out by the petitioner, respondent/Competent Authority is directed to consider and decide the representation of the petitioner dated 08.05.2025 - 3 - (Annexure P-3) as recommended by the officiating Commanding Officer, Military Hospital, Dalhousie, District Chamba, Annexure P-2, within ten days from today, in accordance with law also keeping in view the concession flowing to her under Clause 5.2 of the applicable Transfer Policy. Copy of decision so taken, be communicated to the petitioner. Till such time, petitioner shall not be compelled to join at the transferred station.
