2. This is an application filed by the petitioners praying for grant of anticipatory bail in terms of Sections 482 and 484 of the Bharatiya Nagarik Suraksha Sanhita, 2023 apprehending their arrest for the offences under Sections 303(2)/317(2)/3(5) of the Bharatiya Nyaya Sanhita, 2023 and Rule 4/54 of Jharkhand Minor Mineral Concession Rule, 2004.
3. Learned A.P.P. representing the State opposes the prayer for anticipatory bail.
4. Petitioners were instrumental in transporting and taking illegally mined earth, which is mineral.
5. Considering the nature of allegation and transportation of illegally mined earth which has a severe impact on environment and State exchequer, I find that this is not a fit case for grant of anticipatory bail to the petitioners. Accordingly, the prayer for anticipatory bail of the petitioners in connection with Radhanagar P.S. Case No.70 of 2025, pending in the Court of learned Judicial Magistrate- 1st Class, Rajmahal, stands rejected.
6. Petitioners should appear before the concerned Court and take an appropriate step, which would be considered in accordance with law.
