THIS PETITION, COMING ON FOR ORDERS, THIS DAY, ORDER WAS MADE THEREIN AS UNDER: CORAM: HON'BLE MR JUSTICE MOHAMMAD NAWAZ ORAL ORDER Petitioners/accused Nos.1, 2 and 4 respectively in Crime No.78/2024 of Kuderu Police Station, Chamarajanagar, registered for the offence punishable under Section 352, 109, 74, 118(1), 3(5), have preferred this petition under Section 482 of BNS, 2023, praying to enlarge them on anticipatory bail. 2. Heard both sides and perused the material on record. - 3 - NC: 2025:KHC:6772 CRL.P No. 1195 of 2025 3. A perusal of the complaint lodged by Smt.Shashikala W/o. Shankara goes to show that, on 09.12.2024, on account of a civil dispute, the accused have assaulted her, her husband Shankara and her brother-in-law Nagaraju with an iron rod, ripees patti etc. The villagers by name Punith and Mahadevashetty are said to have pacified the quarrel and shifted the injured to Government Hospital at Santhemarahalli for treatment. 4. It is submitted that in respect of the very same incident which took place on 09.12.2024 at around 10.00-10.30 a.m., a complaint was lodged by accused No.3 in the present case, which is registered in crime No.77/2024 at Kuderu Police Station, Chamarajnagar, against Nagaraju, Shankara and Shashikala namely the injured in the present case, for offences punishable under Section 329(3), 118(1), 76, 351(2), 351(3), 109, 3(5) of BNS, 2023. Accused Nos.1, 2 and 3 in the present case have also sustained injuries in the incident and they took treatment at CIMS Hospital, Chamarajnagar. 5. The incident is on account of a civil dispute. Both the parties have sustained minor injuries and they have - 4 - NC: 2025:KHC:6772 CRL.P No. 1195 of 2025 registered cases against each other. It is submitted that the accused in the counter case have been enlarged on bail. Petitioners have undertaken to cooperate with the investigation. 6. In the above facts and circumstances, by imposing necessary conditions, the relief sought in this petition can be granted. Accordingly, the following: O R D E R Petition is allowed. Petitioners/accused No.1, 2 and 4 in Crime No.78/2024 registered at Kuderu Police Station, Chamarajnagar, shall be released in the event of their arrest, subject to following conditions: a) They shall appear before the Investigating Officer within one week from the date of receipt of a copy of this order and shall execute a bond for a sum of Rs.1,00,000/- (Rupees One Lakh only) each with two sureties for the likesum. b) They shall furnish proof of their residential address/contact number and shall inform - 5 - NC: 2025:KHC:6772 CRL.P No. 1195 of 2025 the I.O. in case of any change in the address/contact number. c) They shall co-operate with the investigation of the case. d) They shall not tamper with the prosecution evidence/witnesses either directly or indirectly. e) They shall be regular in attending the Court proceedings.
