Priya Shrestha, Spl.P.P --- 02/04.07.2025 Heard the Parties. Petitioner has been made an accused in connection with Daltonganj Town P.S. Case No. 28 of 2024, arising out of NDPS Case No. 04 of 2024, for the offences registered under Sections 20, 20b(ii), 22 of NDPS Act, pending in the court of learned Special Judge under NDPS Act, Palamau, Daltonganj. Bail application of the petitioner was earlier rejected by this court vide B.A. No. 6951 of 2024 by order dated 28.10.2024. It is alleged that about 15 grams of heroin has been recovered from the possession of the petitioner. It was submitted that the quantum of recovered contraband comes within the purview of intermediary quantity. It was further submitted that the petitioner is in custody since 16.01.2024. It was finally submitted that similarly situated co-accused has been granted bail by co- ordinate bench of this court. Regard being had to the facts and circumstance of the case, the petitioner named above, is directed to be released on bail on furnishing bail bond of Rs. 20,000/- (Twenty Thousand only) with two sureties of the like amount each to the satisfaction of learned Special Judge under NDPS Act, Palamau, Daltonganj in connection with Daltonganj Town P.S.
