JUSTICE SUDESH BANSAL Order 06/05/2025 1. By way of instant writ petition, petitioner has assailed his transfer order dated 15.01.2025 whereby he has been transferred as Nursing Officer from Sub District Hospital, Bandikui, District Dausa to Mathuradas Mathur Hospital, Jodhpur. 2. Petitioner has filed an appeal before the Rajasthan Civil Services Appellate Tribunal, Jaipur stating inter alia that petitioner’s mother is aged and seriously sick in the appeal, the Tribunal on the concession of counsel for appellant, permitted the petitioner to submit a representation before the respondents, which was directed to be considered and decided within a period of 30 days. [2025:RJ-JP:19034] (2 of 2) [CW-5556/2025] 3. This Court is of the considered opinion that the order to submit the representation has been passed by the Tribunal on the concession of counsel for appellant, hence, in such circumstances, petitioner is estopped from assailing the transfer order or the order of the Tribunal on merits and the writ petition is wholly misconceived, which deserves to be dismissed with cost. 4. Counsel for petitioner, after arguing the writ petition for some time, seeks permission to withdraw the same. 5. Accordingly, the writ petition is dismissed as withdrawn. 6. Stay application and other pending application(s), if any, stand disposed of. (SUDESH BANSAL),J NITIN /25
