Notice. Mr. L.N.Sharma, learned Additional Advocate General and Mr. T.R.Sharma, learned Counsel, appear and waive service of notice on behalf of respondents No. 1 to 3 and respondent No.4, respectively.

This writ petition has been filed for grant of following substantive reliefs: -
1 Whether reporters of Local Papers may be allowed to see the judgment? yes
- 2 - ia) To issue Writ in the nature of Mandamus directing the respondents to grant Pension to the Petitioner immediately from due date i.e 31.08.24 (date of retirement) (b) That the service rendered by the Petitioner as a Para Teacher on31,9735 the post of Shastri from 2004 followed by regularization in 2014 may be counted for Pensionary Benefits in the light of the
Judgment as rendered in Jagdev singh case annexed as Annexure P-1. (c) That the Petitioner may be granted all consequential benefits including full arrears till date.”

Learned counsel for the petitioner submitted that the issue involved and the relief prayed for by the petitioner has already been adjudicated Jagdev Singh and Ors Vs. State of H.P. and Ors2. Learned counsel for the petitioner submits that the petitioner would be content in case petitioner is permitted to file representation. Learned counsel for the respondents have no objection to this prayer.

Having regard to above submissions but without examining the merits of the matter, this petition is disposed by permitting the petitioner to file representation within two weeks, which shall be decided by the respondents/competent authority within six weeks from the date of receipt of the

- 3 - same, keeping in view the aforesaid judgment. The decision so arrived at, shall be communicated to the petitioner.
Pending miscellaneous application(s), if any, also to stand disposed of.
