The present petition has been filed challenging the order dated 23.04.2013 whereby the request of the petitioner to decide the preliminary issue was rejected as well as the order dated 11.10.2013, whereby the revision filed against the said order was also dismissed. Considering the fact that it is the discretion of the trial court to decide the issue in the manner, it deems fit after the issue decided, I do not see any reason to interfere in exercise of power under Article 227 of the Constitution of India.
