Both the courts have recorded a finding that the recall application was not maintainable under Order 9 Rule 13 C.P.C.as the service was duly effected and the proviso to Section 17 was also not complied with. In view of the said finding of fact, no interference is called for. The writ petition lacks merits and is accordingly dismissed.
